William J. Fune, Oneil, NE, waived formal arraignment and pleaded not guilty to possession of a controlled substance except 35 grams or less of marijuana/synthetic cannabinoid and had his case set for Aug. 10.
Erin N. Gathercole, Trenton, waived formal arraignment and pleaded not guilty to tampering with a victim in a felony prosecution and is scheduled to appear in court Aug. 10.
Samuel J. Southers, Trenton, was sentenced to serve four years in the Department of Corrections on a charge of unlawful use of a weapon and 15 years each on two charges of distribution/delivery/manufacture/production of a controlled substance. The sentences are to run concurrently. Execution of the sentences was suspended and he was placed on probation for five years. He had earlier pleaded guilty to the charges.
Gary D. Hanes, Trenton, had a one-day jury trial set for Jan. 9, 2018 on charges of fourth degree assault, third degree assault (special victim) and resisting arrest.
Donna L. Zeigler vs. State of Missouri. The court took under advisement the petitioner’s motion to vacate, set aside or correct a judgment or sentence. She is in the Department of Corrections following a conviction for stealing and fraudulent use of a credit device.
Shelly L. Gallagher, Trenton, changed her plea to guilty on a charge of possession of a controlled substance except 35 grams or less of marijuana. She was sentenced to serve three years in the Department of Corrections, with execution of the sentence suspended. She was placed on probation for five years and is to pay $300 to the Grundy County Law Enforcement Fund.
Vickie L. Russell, Mercer, pleaded guilty to passing bad checks and was fined $100.
Shannon M. Brake, Trenton, admitted violating the terms of his probation on an original charge of possession of a controlled substance except 35 grams or less of marijuana. His probation was continued, with special conditions.
Kelsey R. Howard, Trenton, admitted violating the terms of her probation and had it continued with the special condition that she complete community service previously ordered within 30 days and OOA as scheduled. Her original charges of two counts of possession of a controlled substance except 35 grams or less of marijuana.
Rhonda R. Howard, Trenton, admitted violating the terms of her probation on two original counts of possession of a controlled substance except 35 grams or less of marijuana and had her probation continued with the special condition that she pay $150 per month toward the amount owed.
Angela D. Oyler, Trenton, admitted violating the terms of her probation and had it continued with the special condition that her costs being paid be considered restitution. Her probation was extended for one year in the case, which involved her conviction on a charge of delivering or attempt to deliver a controlled substance to a county jail.
Colby Weaver, Trenton, changed his plea to guilty on a charge of sexual misconduct involving child under 15, a class D felony and pleaded guilty to an amended charge of second degree sexual abuse, a class E felony. Sentencing was set for Sept. 7.
Levi G. Bell, Trenton, admitted violating the terms of his probation on two original charges of second degree burglary. His probation was continued with the additional condition that he successfully complete the CODS program in the Department of Corrections, with the court retaining jurisdiction for 120 days.
Michael J. Welling, Eagle-ville, had a three-day jury trial set for Feb. 26 on a charge of statutory rape.
Clifford M. Eiler, Kirksville, admitted violating the terms of his probation and had his stay of execution set aside and the sentences ordered executed. He was ordered to serve 10 years in the Department of Corrections on a charge of receiving stolen property and seven years in the DOC on a charge of tampering with physical evidence in a felony prosecution. The sentences are to run concurrently.
