Some Grain Claims Denied

Several claims made against Gallatin Livestock Auction have been denied, according to a story in the Gallatin North Missourian newspaper.

The Department of Agriculture notified 14 of 16 claimants that they would not be receiving payment for business actions they had with Daniel Froman d/b/a Gallatin Livestock, which is now out of business. The two claims approved by Judge W.B. Tichenor, who is the senior hearing officer for the State Tax Commission, included Ken Klingensmith for $852.56 and Riverbend Cattle Company for $82,100.
A hearing was held on June 25 at the Daviess County Courthouse in Gallatin, during which time around $294,000 claims had been submitted. However, in the July 23 ruling, the claims were in excess of $400,000. The amount of bond funds available to cover claims was $129,719.43 ($125,000 bond plus interest).
The 14 unsuccessful claims, according to the newspaper, were denied for a variety of reasons, including insufficient documentation, transactions not directly related to the sale of livestock or “untimely” claims, meaning claims were not filed within the time limitations. Seven claims denied were for less than $10,000 while seven others were for more than $10,000.
