Judge Jack Peace
Michael A. Wilson, 20, 1850 E. Eighth St., was released on a personal recognizance bond in the amount of $10,000 on a charge of violating a protection order for a child. He is scheduled to appear in court on Sept. 13, when he will also face charges of second degree burglary and a probation violation for unlawful use of a weapon.
James Lee Miller, Jr., 40, Lexington, waived formal arraignment and pleaded guilty to one count of non-support, with two other counts dismissed. He was sentenced to serve two years in the Department of Corrections, to run concurrently with a Lafayette County case.
Shirley Hutchison, 50, 707 E. Eighth St., pleaded guilty to an amended charge of misdemeanor passing bad checks (the original charge was a felony) and was fined $100 and costs, plus $46 to the Crime Victim’s Compensation Fund.
James L. Baker, 46, 108 W. 16th St., had his bond increased to $50,000 on two counts of sexual abuse. He will be allowed to post 10 percent of that amount, with the special conditions that neither he nor his family have any contact with the alleged victims.
Timothy Harding, 23, Trenton, pleaded guilty to second degree assault and was sentenced to serve three years in the Department of Correction, with the case to run concurrently with another Grundy County assault case from 2002 in which he had violated the terms of his probation.
Jacob Gruenewald, 19, 706 E. Fifth St., violated the terms of his probation on an original charge of theft/stealing and had his probation continued with the special condition that he enter the Third Circuit Treatment Program.
Rex A. Winters, 37, 509 Monroe St., pleaded guilty to two counts of non-support, with four other counts dismissed. Sentencing was set for Oct. 11. He waived formal arraignment and pleaded not guilty to possession of a chemical with intent to create a controlled substance or a controlled substance analogue. He is scheduled to appear in court against Sept. 13.
Dirk Erp, 45, 430 N. HIghway 65, pleaded guilty to two counts of driving while intoxicated (persistent offender) and had sentencing on those charges set for Oct. 11. He pleaded guilty to operating a motor vehicle in a careless and imprudent manner and was sentenced to serve 30 days in the Grundy County Jail, with credit given for time served. He is also to pay costs and $46 to the CVCF on that charge. Two counts of failing to drive on the right half of the roadway when the roadway was of sufficient width, causing an immediate threat of an accident were dismissed, as was one count of not wearing a seat belt.
Dustin G. Kimberling, 22, Jamesport, pleaded guilty to one count of non-support, with three others dismissed. He was placed on probation for five years.
Oscar Rubio, 54, St. Joseph, had four counts of passing bad checks dismissed.
Faron W. Lawrence, 41, Spickard, had a motion to dismiss charges of possession of a controlled substance except 35 grams of marijuana or less and unlawful use of drug paraphernalia granted.
Ashley M. Kincaid, 24, 1609 Bolser St., had a two-day jury trial set to begin Nov. 29 on a charge of endangering the welfare of a child.
Paul Damon, Gilman City, pleaded guilty to stealing without consent and had sentencing set for Oct. 11.
Daniel W. Phelps, Chillicothe, waived formal arraignment and pleaded not guilty to three counts of passing bad checks and was fined Sept. 13.
Brandi McDaniel, 23, Trenton, pleaded guilty to one count of passing bad checks and had six counts dismissed. Sentencing was set for Sept. 13.
David T. Gathercole, 43, 73235 Hillcrest, pleaded guilty to one count of non-support, with four counts dismissed. Imposition of his sentence was suspended and he was placed on probation for five years, with the special conditions that he pursue vocational rehabilitation, apply for disability and appear in court Feb. 14., 2008.
Associate Civil
Cathy Jenkins and Vern Jenkins vs. Wayne King. A jury trial was set for Feb. 6, 2008 in the case, which involved a personal injury sustained in a fall.
Division II
Judge Steven D. Hudson
Manuel J. Quintana, 17, Spickard, pleaded guilty to not wearing a seat belt and was fined $10.
Levi G. Bell, 25, 316 E. 17th St., pleaded guilty to an amended charge of assault (the original charge was first degree burglary). He was sentenced to serve six months in the Grundy County Jail, with execution of the sentence suspended. He was placed on probation for six months and is to pay $104.50 costs, $10 to the CVCF and make restitution to the victim. He is also to serve eight days shock time in the Grundy County Jail and was given credit for time served.
David D. Leo II, 34, Milan, pleaded guilty, pursuant to a plea agreement, to an amended charge of stealing (the original charge was second degree burglary) and was sentenced to serve six months in the Grundy County Jail. Execution of the sentence was suspended and he was placed on probation for two years, with the condition that he pay $104.50 costs and $10 to the CVCF.
