Judge Jack Peace
Brian F. Israel, Donnie Vandevender, Tad Trombley and Ann Trombley vs. Western Fireproofing Co. of Kansas, Inc. The case was dismissed in regard to the Trombleys and Vandevender. The defendant’s motion to dismiss was denied in regard to Israel. The court granted 20 days to file an amended petition with the defendant given 30 days to respond. The case involves property damage.
Division II
Judge Steven D. Hudson
Duane L. Shiner, 18, 213 W. Crowder Rd., had his cases certified to Division I on charges of violating a protection order, interfering with custody and escape or attempted escape from confinement. Trial-setting was scheduled for April 12.
Clinton Forbes, 23, Blue Springs, waived his preliminary hearing and had his case bound over to Division I on charges of tampering with a motor vehicle. Trial-setting was scheduled for April 12.
Cary L. Sharp, 28, 710 Kumler St., pleaded guilty to operating an all-terrain vehicle without a bicycle safety flag and was fined $27.50 and $56.50 costs.
Pleading guilty to not wearing a seat belt and fined $10 were Amy J. Babbitt, 27, Humphreys; Misty D. Mason, 27, Spickard; and Alexandria Mefford, 36, 506 Grundy St.
Lorilee A. Johnson, 36, Gallatin, pleaded guilty to failing to show proof of insurance and not wearing a seat belt and was fined $27.50, $10 and $56.50 costs.
Jacob N. Cook, 28, Gallatin, pleaded guilty to speeding and was fined $37.50 and $56.50 costs.
Joshua W. Carpenter, 29, Laredo, pleaded guilty to driving a truck under 18,000 pounds that was following another vehicle too closely and was fined $52.50 and $56.50 costs.
Lauren F. Waterbury, 18, Jamesport, pleaded guilty, pursuant to a plea agreement, to an amended charge of speeding one to five miles over the speed limit (the original charge was speeding 75 miles per hour in a 60 zone) and was fined $200 and $56.50 costs.
Alvin M. Peterie, 37, Route 5, pleaded guilty, pursuant to a plea agreement, to an amended charge of having no valid license (the original charge of operating a vehicle on the highway while his driver’s license was revoked) and not wearing a seat belt. He was fined $250, $10, $104.50 costs and $10 to the Crime Victim’s Compensation Fund.
Tony E. Powers, 20, 1303 W. Harris Ave., was found not guilty of assault.
Timothy J. Hampton, 42, Chula, was fined $27.50 and $56.50 costs on a charge of failing to drive on the right half of the roadway, resulting in an accident. He was fined $150.50, $104.50 costs and $10 to the CVCF on a charge of leaving the scene of a motor vehicle accident. He had earlier been found guilty of both charges.
Joshua D. Phillips, 26, 1508 Mable St.,waived formal arraignment and pleaded guilty to third degree assault. He was sentenced to serve 45 days in the Grundy County Jail and was given credit for eight days served. He was remanded to the custody of the sheriff’s department to serve the remaining 37 days.
Kimberly J. Anderson, 43, 120 S. Highway 65, pleaded guilty to failing to register a motor vehicle annually with the Director of Revenue and was fined $27.50 and $56.50 costs.
Associate Civil
Unifund CCR Partners vs. Donald Jones. The court ruled in favor of the plaintiff in the amount of $1,229.49. Execution of the judgment was stayed as long as payments are made every 15 days. The case involved breach of contract.
